The former Rolla man accused of threatening to blow up the Rolla Police Department and later convicted on federal weapons charges stemming from the same series of incidents is no longer facing additional charges out of Phelps County.
Phelps County Prosecuting Attorney John Beger dropped the felony charge of making a terrorist threat, indicating additional charges may be filed at a later date.
Lowell Aughenbaugh was accused of threatening to blow up the Rolla Police Department and kill his own family members living in Rolla on New Year’s Eve, 2009.
After the initial report of the threats, the Phelps County Sheriff’s Department served a search warrant where they found nearly 100 firearms, 300,000 rounds of ammunition and items used to build explosive devices believed to be owned by Aughenbaugh.
Aughenbaugh was convicted on a federal weapons charge and a federal charge of making threats to harm family members and police officers after entering a guilty plea in federal court in July, 2011.
He is currently in federal prison serving his sentence of 37 months on those charges.
The Class D felony of making a terrorist threat was filed in Phelps County Courts by former Phelps County Prosecutor Courtney George.
“The dismissal (of the charge) was necessary to allow ... more time to review all the evidence against Mr. Aughenbaugh and determine what additional or amended charges might be brought,” Beger said in a press release issued Friday.
Aughenbaugh’s trial was scheduled to begin Jan. 30.
Beger said in the press release the decision to drop the charges was also related to the trial date.
The trial for Frank Colvin, 34, of Rolla, is scheduled to begin the same day.
Colvin has been charged with second-degree murder in connection to the May 16, 2010, death of his roommate, DelRay Wiench.
