Briggs charged with death of St. James woman

The St. James man charged with first degree involuntary manslaughter after Cassy L. (Black) Brady, of St. James, died in a car accident on Route B in June, 2011 is scheduled to face a jury of his peers the same week as the one-year anniversary of Brady’s death.

According to Missouri State Highway Patrol reports, Earl D. Briggs, 21, of St. James, was behind the wheel of the 1996 Mitsubishi Eclipse that rolled several times causing fatal injuries to Brady and injuring Briggs and the remaining five passengers.

Briggs is also facing a charge of second degree assault in relation to the serious injuries to one of those passengers.

In court documents, Phelps County Prosecuting Attorney John Beger accuses briggs of causing the accident because he was driving at a high and dangerous rate of speed.

According to the probable cause statement written by Missouri State Highway Patrol Trooper J. Fariole, the Mitsubishi became airborne as it crested a hill and when it landed the undercarriage struck the roadway, which caused Briggs to loose control of the car.

Fariole writes that the car then crossed the center line, travelled off the roadway, struck a ditch and rolled multiple times.

Brigg’s trial has been scheduled to begin June 28, 2010.

Briggs remains in custody at the Phelps County Jail after failing to appear for a counsel status hearing in October and having his bond revoked.
Judge Mary Sheffield decided Jan. 9 to give Briggs another chance to post bond by setting a new bond at $120,000.

As of Friday Briggs had not posted that bond.

His initial bond, which he posted directly following his first arrest in this case, was set at $100,000.

If convicted of both charges, Briggs faces a possible sentence of up to 14 years in prison.
