Frank Colvin, 32, is in the Phelps County Jail pending charges of second degree murder after being arrested early Sunday morning.

Phelps County Sheriff’s deputies responded to assist a request for an ambulance on the 12,000 block of County Road 4010, where Delray Wiench, 50, was reported to not be breathing.

According to Detective Sgt. Andy Davis, who described the two men as “friends,” it was Colvin who made the 911 call.

Arriving to the home before EMS, Deputy John Scott, who is also a paramedic, initiated CPR on Wiench after finding Colvin kneeling over him, according to Davis.

After EMS arrived on the scene, Wiench was taken to Phelps County Regional Medical Center where he later died that morning.

According to a press release from the Sheriff’s Department, the individuals became involved in an altercation, when Colvin allegedly grabbed Wiench by the throat and struck him several times in the face with his fist. The Sheriff’s Department also stated there was no evidence a weapon was used in the altercation.
